Grandparents or “Person Other Than A Parent” Visitation Rights.

 

Parents have a constitutional right to parent his or her child and Utah law has a rebuttable presumption that a parent’s decision with regard to grandparent visitation is in the grandchild’s best interest. As such the parents have discretion of whether or not the child should have a relationship with his or her grandparents.

 

However a grandparent or a person other than a parent can bring a petition for visitation with the child under appropriate circumstances. The court may override the parent's decision and grant the petitioner reasonable rights of visitation if the court finds that the petitioner has rebutted the presumption.
